It's a good case, but it's a BS way to claim that the original Treason case isn't valid. First off "intentionally" is a far weaker standard than "knowing," and the fact that the CIA sought to keep a non-diplomatic agent's identity concealed automatically is assumed. He can also be charged with unlawful possession of classified information.
Basically, the dude's fucked, the Federal judges all hate Bush because of the Schiavo thing, and the facts are stacked against Rove. And once the boys in the penitentiary find out who he is...
